Employers Now Required to Disclose Electronic Monitoring
The Digital Platform Workers’ Rights Act, 2022, was enacted on April 11, 2022, requiring employers to disclose any use of video surveillance to employees. This means that Ontario employers must now have an electronic monitoring policy that states whether employees are being electronically monitored, and if so, how and in what circumstances the employer is using such monitoring.
Our existing policy materials address the requirements of this act already, but we will be updating all policies to clearly indicate whether you are monitoring employees (or not) as required by the legislation. If you are conducting electronic monitoring of any kind in your workplace, please contact us so we can amend your policy accordingly.
Employers have until October 11, 2022, to have this policy in place, however, we plan to ensure full compliance well ahead of this deadline. Please feel free to contact us if you need additional assistance or information in the meantime.
